Identification surveys provide critical information including but not limited to encroachments, easements and restriction of the title. They also show setback from the boundaries to the relevant structures such as dwellings, garages, sheds, fences and retaining walls.

In our opinion every purchaser should seek both an identification and a building certificate from the relevant council to ensure that the house or building complies fully with council regulations.

 

 

Why do I need an Identification Survey in NSW?

As the price of the average Australia home grows closer to the magic million dollar mark so does the importance of making informed decisions. Within NSW the law is undoubtedly underpinned by the term “CAVEAT EMPTOR” which states ‘buyer beware’. It is you as the buyer’s responsibility to ensure that you are making an informed decision. Some things to be of concern are;

  • Is the building completely within the bounds of your land (NOT THE FENCES).
  • Do other building encroach on your land?
  • Do other people have easements over or rights to use your land?
  • Do you have easements over or rights to use other people’s land?

 

The conveyancing Act requires the vendor to provide certain information to prepare the contract for sale but are not required to show any information defining boundaries, encroachments or easement.

An identification survey is generally only a few hundred dollars more than an insurance policy and provides you with all the information you need to make an informed decision on your purchase.

(This is highly recommended to anyone who is buying with the intent to develop or improve the land)

 

 

What is included in Identification Surveys?

Upon completion of the survey you will be provided with a report of the subject property, this report includes a sketch showing the following;

  • The dwellings setback from relevant boundaries
  • The position of fences.
  • The sketch will show any encroachments of the subject dwelling on neighbouring properties if required.
  • The sketch will also show encroachments of neighbouring dwelling upon subject property if required.
  • The position of any easements upon the subject property will also be shown on the sketch.

 

The report will give our profession opinion as to whether the existing dwelling will comply with restrictions on the use of land or restrictive covenants of the title on the land.
